1. Data controller

The controller of personal data collected on this site is OpenUp Agency, registered office in Papeete, French Polynesia. Contact: contact@openupagency.com · +689 87 32 48 40.

2. Data we collect

• Contact form: name, email, optional phone, optional company, your message.
• Analytics: anonymised page views and behavior (Google Analytics 4 + Vercel Analytics) — IP partially anonymised.
• Technical logs: server logs (IP, user agent, request URL) for security and uptime monitoring, kept 30 days.

3. Why we process it

• To respond to your contact request (legal basis: pre-contract / your request).
• To improve the site (legal basis: legitimate interest).
• To detect abuse / attacks (legal basis: legitimate interest).

4. Who has access

Only OpenUp Agency staff. Subprocessors used: Vercel (hosting analytics), Google (Analytics 4), n8n self-hosted on our VPS (form workflow), Resend (transactional email). All have signed DPAs (Data Processing Agreements) compliant with GDPR.

5. International transfers

Data may be transferred to the EU (Vercel, Hostinger) and to the United States (Google) under the EU-US Data Privacy Framework. We do not sell your data to anyone, ever.

6. Retention

• Contact form messages: 3 years from last contact.
• Analytics: 14 months (Google Analytics default).
• Server logs: 30 days.

7. Your rights

Under GDPR, you have rights of: access, rectification, erasure, restriction, portability, objection, and the right to lodge a complaint with the CNIL (France) or your local data protection authority. To exercise these, write to contact@openupagency.com. We commit to responding within 30 days.

8. Cookies

We use minimal essential cookies and anonymised analytics cookies. No advertising or tracking cookies. You can configure your browser to refuse cookies — the site will still work.

9. Updates

This policy may be updated. The "last updated" date at the top reflects the most recent change.

10. Children

Our services are not directed at people under 16. We do not knowingly collect data from minors.
